New Building Consent Exemptions
The Government has announced that new types of building work will no longer require a building consent and local council permission under the Building Act, the date this comes into effect is yet to be announced. Below is an overview of the building types that will be exempt from consent requirements.
- Under 30m2
- Single story
- Must be located away from all boundaries by the distance of its height from the ground to the top of the roof
- Must be located away from all other buildings by the distance of its height from the ground to the top of the roof
- Cannot have any plumbing services in it ie:
– no bathrooms
– no laundries
– no toilets etc - Must comply with all planning rules i.e:
– cannot cause the section to go over the building coverage
– cannot cause the section to go over the permeability limit
– cannot be built within the front yard area
– cannot be built within a riparian setback - Must still comply with NZS3604 and NZBC, IE has to be designed by an LBP designer or an engineer
- Needs to be either owner built or by an LBP builder
